This Privacy Policy shall apply to www.swimstrongdryland.com (the “Website”), a website owned and operated by SwimStrong Dryland, LLC, a Pennsylvania limited liability company, (“SSDL”, “our”, “us”, or “we”), the SSDL mobile application, and to any other SSDL-owned websites and mobile applications, as well as to any SSDL profile on any social media sites and to any other digital services and platforms officially operated or used by SSDL, and also to information collected about you by SSDL from time to time through other means (such as by phone, in person or on paper (our “Sites” or “Services”).
SSDL is concerned about your privacy and wants you to be familiar with how we collect, use and disclose information you provide to us while visiting our Sites. This Privacy Policy describes our practices in connection with information that we collect through our Sites. By using our Sites, you agree to the terms and conditions of this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, do not use our Sites.
HOW WE GATHER INFORMATION ON OUR SITES

What Personal Information do we process? When you visit, use, or navigate our Services, we may process Personal Information depending on how you interact with us and the Services, the choices you make, and the products and features you use.
Do we process any sensitive information? Some of the information may be considered “special” or “sensitive” in certain jurisdictions, for example your racial or ethnic origins, sexual orientation, and religious beliefs. We may process sensitive Personal Information when necessary with your consent or as otherwise permitted by applicable law.
Do we collect any information from third parties? We do not collect any information from third parties.
How do we process your information? We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with the law. We may also process your information for other purposes with your consent. We process your information only when we have a valid legal reason to do so.
In what situations and with which parties do we share Personal Information? We may share information in specific situations and with specific third parties.
How do we keep your information safe? We have adequate organization and technical processes and procedures in place to protect your Personal Information. However, no electronic transmission over the internet or internet storage technology can be guaranteed to be 100% secure.
Do we collect information from children under the age of 13? Yes. We will obtain verifiable parental consent before we collect, use, or disclose Personal Information from a child under the age of 13.
What are your rights? Depending on where you are located geographically, the applicable privacy law may mean you have certain rights regarding your Personal Information.
How do you exercise your rights? The easiest way to exercise your rights is by submitting a data subject access request, or by contacting us.
1. WHAT INFORMATION DO WE COLLECT?
Personal Information
We collect Personal Information that you voluntarily provide to us when you register for the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The Personal Information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The Personal Information that we collect that identifies you as an individual may include the following:

- Home or business address
- Telephone number
- Birth date
- Billing and delivery information
- Email address
- Usernames
- Passwords
- Debit/Credit Cards
- Contact Preferences
- Contact or authentication data
Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

- Photographs
Payment Information. We use third-party payment processors for any payment made in connection with the Sites and we do not collect payment or financial information.
Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:
- Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of our application(s) you accessed.
- Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings.
- Camera Access. We request access to your camera solely for the purpose of enabling features that require image or video capture. We do not access, store, or transmit any photos, videos, or audio from your camera unless you explicitly choose to save or share them through the app. Any images or videos you capture are used only for the functionalities you select within the app, such as saving to your device or sharing with other users. We do not use your camera data for advertising or analytics purposes.
This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.
Information Automatically Collected
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
Anonymous Information Collected
We collect limited technical, diagnostic, and analytics information automatically when users interact with our application, including crash and error telemetry, such as error messages, stack traces, device and operating system information, app version information, and related troubleshooting data. We also processes certain network and request metadata, including IP-address-based information, for security, fraud prevention, rate limiting, and service integrity purposes. We may also collect standard app analytics information, such as app opens, session and engagement data, general app interaction events, screen usage information, and device/app configuration data used to understand and improve product performance and usage patterns. Although some of this automatically collected information may be aggregated or used in a non-directly identifying manner, certain technical telemetry may still contain identifiers or identifier-adjacent data necessary for debugging, security, and service operations, and therefore should not be categorized as exclusively anonymous information.
2. HOW DO WE PROCESS YOUR INFORMATION?
We use your Personal Information for a variety of reasons, depending on how you interact with our Services, including:
- To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
- To deliver and facilitate delivery of the Services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the Services.
- To send administrative information to you. We may process your information by sending you details about our products and services, changes to our terms and policies, and other similar information.
- To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
- To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
- To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more.
- To post testimonials. We post testimonials on our Services that may contain Personal Information.
- To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
- To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.
- To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
- To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
- To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.
We will not provide your Personal Information to third parties for their use in marketing third-party products or services to you without your consent.

We may process your information if you have given us specific permission (i.e., express consent) to use your Personal Information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time. In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:
- If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
- For investigations and fraud detection and prevention
- For business transactions provided certain conditions are met
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced

- We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments
3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
We may share your Personal Information in specific situations described in this section and/or with the following third parties:
Vendors, Consultants, and other Third-Party Service Providers. We may share your Personal Information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do the work. Business Transfers. We may share or transfer your Personal Information in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company.
Legal Reasons. We may share your Personal Information as we believe to be necessary or appropriate under applicable law, including laws outside your country of residence (a) to comply with legal process; (b) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (c) to enforce our terms and conditions; (d) to protect our operations or those of any of our affiliates; (e) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (f) to allow us to pursue available remedies or limit the damages that we may sustain.
4. THIRD PARTY SITES
This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any Sites to which our Sites contains a link or a widget. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. We cannot guarantee the safety and privacy of data you provide to any third-party websites. The inclusion of a link on our Sites does not imply endorsement of the linked site by us or by our affiliates. We may also utilize framing techniques that may make it appear that you are still on our Sites when you are actually on a third party website.
5. HOW DO WE KEEP YOUR INFORMATION SAFE?
We use reasonable organizational, technical and administrative measures to protect Personal Information under our control. For example, with regard to our internal operations, only authorized officers and employees and authorized third party service providers are permitted to access Personal Information, and they may do so only for permitted business functions. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the “How To Contact Us” section below.
6. HOW LONG DO WE KEEP YOUR INFORMATION?
We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required by government legislation and regulations or as necessary to resolve disputes, enforce our agreements and administer our relationships with our ad networks and other third parties. When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, of, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. If you wish to request that we no longer use your information, please follow the instructions above. If you request that we delete your Personal Information, we will use reasonable commercial efforts to do so no later than three (3) months after receiving your request, unless a longer retention period is required by law.
7. YOUR PRIVACY RIGHTS AND CHOICES.
We provide every user with the right to:
- Be informed. It’s your right to be informed of the Personal Information we process about you, and how we process it. We inform you through this Privacy Policy, through information provided to you through the Sites, and by answering your questions about our Privacy Policy when you contact us.
- Access. It’s your right to request access to the Personal Information that we process about you.
- Correct. It’s your right to request that we amend or update your Personal Information where it may be inaccurate or incomplete.
- Delete. It’s your right to request that we delete your Personal Information, under certain conditions
- Restrict. It’s your right to request that we restrict the processing of your Personal Information, under certain conditions.
- Object. It’s your right to object to our processing of your Personal Information, under certain conditions.
- Opt out of sharing of your Personal Information. It’s your right to opt out of sharing your Personal Information with:
- Certain data service companies that help us better understand our audiences, and may also use your information for their own purposes.
- Advertising partners that display targeted – including cross-context behavioral –advertisements to users around the web.
- Data portability. It’s your right to request a machine-readable copy of your Personal Information, or that we transfer the Personal Information that we have collected to another organization, under certain conditions.
- Not be subject to automated decision-making. It’s your right to opt out of automated decision-making (decisions based solely on autonomous decision-making, that is, a decision made without human involvement)), including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.
- Withdrawal of consent. It’s your right to withdraw your consent to us for our processing of your Personal Information in the circumstances in which we rely on your consent to process your information.

Please be aware that your exercise of these rights is subject to certain exceptions, such as to safeguard the public interest as well as our interests (for example, our ability to maintain legal privilege and provide our content).
8. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law also provides that California residents are entitled to know how we respond to “Do Not Track” browser settings. The Sites do not currently respond to “Do Not Track” signals, as there is currently no industry or legal standard for doing so.
9. CROSS-BORDER TRANSFER
Your Personal Information may be stored and processed in any country where we have facilities (at present, only the United States). By providing any Personal Information to us, you consent to the transfer of such Personal Information to countries outside of your country of residence, including the United States, where SSDL develops a presence, which may have different data protection rules from your country of residence.
10. CHILDREN’S PRIVACY NOTICE
This Children’s Privacy Notice explains how we collect, use, disclose, and protect Personal Information from children under 13 in connection with the Services. This notice is intended to comply with the U.S. Children’s Online Privacy Protection Act
(“COPPA”). This Notice applies when we collect Personal Information online from a child under 13, including when (a) the Services are directed to children under 13, or (b) we have actual knowledge that we are collecting Personal Information from a child under 13.
Information We Request From Children
Before we collect, use, or disclose Personal Information from a child (unless an exception applies), we will obtain verifiable parental consent. We do this through requiring a user’s birth date when creating an account in our application and restricting access to any user under the age of 13. A user creating a “managed account” in our application who discloses that the account is for a child under the age of 13 must confirm that the user is the parent or legal guardian of such child, is responsible for supervising the child’s use of application and managing the child’s user account, and must consent to the collection of Personal Information in compliance with this Privacy Policy.
We will not ask a child to provide us with more Personal Information than is reasonably necessary to participate in any activity or the Services. If we become aware that we have inadvertently received Personal Information from a child without the legally required prior, verifiable parental consent, regardless of where in the world they are located, we will delete that information promptly.
Information We Collect Automatically
We automatically collect certain information from visitors to our Sites to help us understand trends about our Sites are used. This helps us to maintain and administer the Sites, including to support our security efforts, to make improvements, and to understand aggregated information about the makeup of our visitors.
We use certain service providers to help us collect and understand this information. The information might include, for example, the Uniform Resource Locator (“URL”) from which the visitor arrived, the URL to which you next go, browser information, Internet Protocol addresses, a mobile device identifier, operating system, or general location data such as a city or zip code, as well as information about use of the Sites, such as the pages or sections visited most often, the time spent there, and how a visitor moves through the Sites. When this information is considered to be Personal Information, we treat it in accordance with this section of the Privacy Policy.
We and our service providers collect this information directly from the device through the use of cookies, web beacons, or other similar technologies. A “cookie” is a small data file that a web site transfers to a user’s device and is stored on the user’s browser. As a user moves from one page or one screen to another, a cookie is used to tell us that it is the same device and to remember your preferences. A “web beacon” (also referred to as a “clear gif” or “pixel tag”) is a one-pixel image (which may be visible or transparent), which may be embedded on a web page or in an e-mail message, and which may also provide us with information about usage of that page or e-mail message, including if and when you have opened it. More information about the cookies used in our Sites is below in our Cookie Notice. Most browsers allow you to control placement of cookies by third parties on your browser. How We Use and Share Personal Information Collected from Children
We use Personal Information collected from or about children to operate our business, such as to administer and maintain our Sites and in support of our Sites’ internal operations, in accordance with consent provide by a parent, to comply with our legal obligations, and otherwise as described above. We contract with third parties to provide certain services and to facilitate the internal operations of our Sites, such as data hosting, analytics, and content delivery. These third parties may require access to certain Personal Information, only in order to provide their services.
Managing Personal Information Collected From Children
Parents may contact us at swimstrongdryland@gmail.com with requests to review, update or delete any of their children’s Personal Information that we may have collected, to revoke any consent that had been previously provided, and to elect for us not to collect any additional Personal Information from their children. Please be aware that we may request additional Personal Information in order to verify your identity and your relationship to the child before we can proceed with your request, particularly a request to access a child’s Personal Information. We will use any such Personal Information only to validate the request. We will fulfill any valid request to review, update or delete any such Personal Information within a reasonable time period.
Security and Retention of Personal Information Collected From Children
We maintain reasonable administrative, technical, and physical safeguards designed to protect children’s Personal Information. No method of transmission or storage is 100% secure, but we work to help protect information from unauthorized access, use, or disclosure. We retain children’s Personal Information only for as long as is reasonably necessary to fulfill the purpose for which it was collected, consistent with our legitimate business needs and legal obligations. When the information is no longer needed, we delete it using reasonable measures to protect against unauthorized access or use.
11. DO WE USE COOKIES AND OTHER TRACKING DEVICES?
We use cookies and other tracking technologies, such as web beacons, to collect and store information when you visit our Sites. We may use third-party software development kits (SDKs), which are packaged tools provided by other companies to help power specific features (for example, crash reporting, performance monitoring, or other core app functionality). SDKs may collect limited technical information from your device, such as device identifiers, app version, operating system version, and diagnostic data, to help the app run reliably and improve stability. We configure SDKs to minimize data collection where possible and do not allow SDKs to access your camera content unless needed for an app feature you choose to use. We do not use SDK data for targeted advertising.
12. NOTICE FOR INDIVIDUALS RESIDING IN CERTAIN US STATES
Residents of certain US states, such as California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, and other states to the extent they enact similar privacy laws, may have additional rights under your corresponding state laws (collectively, “US State Privacy Laws”).

We do not sell Personal Information for monetary value nor do we share the Personal Information of users for advertising purposes.
Data Subject Rights: Only you or someone legally authorized to act on your behalf may make a request related to your Personal Information. Please see Your Privacy Rights and Choices for a list of rights we provide to you, as well as how to exercise them. We describe below additional rights that may be available to you under US State Privacy Laws.
- Opt Out of Sharing for Targeted Advertising: You have the right to opt out of sharing your Personal Information for targeted advertising. Currently, the Sites do not share Personal Information for targeted advertising.
- Limit Use of Sensitive Personal Information: We do not use or disclose sensitive Personal Information for purposes other than with your consent to provide the Services, or as otherwise permitted by law.
- Non-Discrimination: We will not discriminate against you for exercising any of your US State Privacy Law rights.
- Appeal: You may have the right to appeal our decision regarding a request related to your privacy rights.
Authorized Agents: You may appoint an authorized agent to exercise any of your privacy rights on your behalf. To verify that your authorized agent acts on your behalf, we will ask for proof from your agent and may require that you also verify your identity.
California “Shine The Light” Law
California has passed legislation requiring certain specific disclosures be made available to California residents who use the Internet and provide Personal Information that may be used for marketing purposes. That legislation requires any business that discloses a customer’s Personal Information (as defined by the legislation) to any third party for direct marketing purposes to provide the customer a method for obtaining the names, addresses and certain other specified details of anyone who might have received that Personal Information.
